Withdraw an application for dispute resolution

Withdraw an application before a hearing

An applicant may withdraw their application for dispute resolution by notifying the Residential Tenancy Branch (RTB) in one of the following ways:

Online

You can withdraw your application through the Online Application for Dispute Resolution any time before the hearing.  Any required documents can be provided by email or in person at the RTB office in Burnaby or your nearest Service BC office.

Phone

Call the RTB any time before the hearing. Any required documents can be provided by:

In person

Visit the RTB office in Burnaby or your nearest Service BC office any time before the hearing and provide any required documentation. 

Email

Email the RTB at HSRTO@gov.bc.ca at least one week before the hearing. The email should have:

  • The file number in the email's subject line (Withdrawal: file #)
  • The required documents attached

If your dispute resolution hearing is scheduled for less than one week away, do not email your documentation. The email may not be processed before the scheduled hearing.

This could result in an arbitrator making a final and binding decision on the matter. 

If your dispute resolution hearing is scheduled for less than one week away, withdraw your application either:


Withdraw an application after the hearing has begun and is adjourned 

If you want to withdraw an application when a hearing has started and is adjourned, you must show that a hearing is no longer necessary.

To withdraw an application at this point in the process, you must provide:

  • The other party’s written consent to the withdrawal
  • A written agreement signed by both parties, setting out the agreed resolutions to all of the issues described in the application

Withdraw a review hearing

You can withdraw your application for a review hearing any time before the scheduled hearing. Only the party who submitted the Application for Review Consideration can withdraw the application.

Withdraw an application to dispute a notice to end tenancy

If you're a tenant and want to withdraw an application to dispute your landlord’s notice to end tenancy, you need your landlord's written consent. 

To withdraw your application, you must provide:

  • A copy of your landlord’s written consent
