Mediation and Arbitration
The director of the forest tenures branch is responsible for appointing a mediator or arbitrator to a dispute, as described under Part 4 of the Timber Harvesting Contract and Subcontract (THCS) Regulation of the Forest Act.
You must use the mediator or arbitrator appointed to you by the ministry to resolve disputes.
Register of Mediators and Arbitrators
The register of mediators and arbitrators will be rotated through when appointing a mediator or arbitrator to maintain equity among appointees.
A letter will be sent to the person initiating the dispute and other party involved, upon request for a mediator or arbitrator. The appointment of a mediator or arbitrator will then be effected by a letter sent to the mediator or arbitrator appointed to the dispute.
All arbitration awards must be sent to the Forest Tenures Branch within 14 days of an arbitrator making an award.
