Road Construction on Agricultural Land

Potential Approval, Permit or Code of Practice Requirements

Road right-of-way dedication and construction in the ALR is regulated by the Agricultural Land Commission Act and Regulation. Minor road expansions such as upgrading an existing road within a right of way, easing a curve or expanding the width of existing constructed road right of way up to 24 meters, are permitted outright by regulation. An application to the Agricultural Land Commission must be made for any new road or expansion of an existing road right of way wider than 24 meters. The application process is the provincially mandated opportunity for the Commission to consider and mitigate the impacts of the road project.
