42  Effective year round, in those portions of M.U. 4-23 outlined in red on the attached Map No. 1-42/20, except that

(a)motor vehicles are permitted

(i)at all times on roads shown highlighted in green on that map,

(ii)during the period June 16 to March 31 inclusive, on roads shown highlighted in orange on that map, and

(iii)during the period December 1 to August 31 inclusive, on roads shown highlighted in purple on that map,

(b)atvs are permitted on the roads shown highlighted in yellow on that map during the period September 1 to November 30 inclusive, and

(c)snowmobiles are permitted at all times except in the areas shown highlighted in hatched purple lines on that map.

Proposed regulation

House Keeping Corrections

• Extend the yellow seasonal open road approximately 1 km from [49.801407°, -114.724251°] to link the remainder of the undesigned road section to the purple seasonal open road at [49.808617°, -114.724973°].

• Move the seasonal open road back approximately 600 m to [49.803902°, -114.730951°] for public safety and ecological concerns due to steep road grade and safe travel.

• Remove approximately 800 m segment of a yellow seasonal open road from [49.776719°, -114.713187°] to [49.781375°, -114.704393°] that does not exist in a sustainable use condition creating safety concerns.

•Realign segment of year-round open road to the actual existing road surface at [49.740437°, -114.717955°] to [49.737301°, -114.718033°].

• Remove approximately 800 m of the year-round open road back to [49.760110°, -114.719177°] the main Alexander FSR where the road is deactivated and un- passable.

• Open approximately 200 m of road to a trapper’s cabin from [49.717274°, -114.704608°] to [49.717529°, -114.703201°]

• Move year-round open road location approximately 1.3 km further into Deadman’s Pass from [49.711618°, -114.675394°] to [49.704819°, -114.661917°] enabling enhanced public access and a defined and understandable stopping location. This will be complimented with a gate installation on the BC Alberta boarder to stop transboundary non- compliance.

Rationale

The proposed regulation changes are intended to (1) correct mapping errors due to inaccuracies in provincial road layers to align with original intent of road access, (2) move closure point to a more suitable location for public safety and ecological damage mitigation, (3) move road closure point to manage compliance and align with road deactivations, (4) provide enhanced year-round public access into Deadman’s Pass, and (5) address non-compliance through a significant high elevation pass.

Detailed field assessments were conducted to determine mapping inaccuracies, road pass ability, public safety, and determination with Teck the private landowner how to mitigate negative impacts of motorized vehicles on conservation values.
