BCAB #1101

Re: Exit Through Interconnected Floor Space, Sentence 3.4.4.1.(7)

With reference to your letter of October 18, 1989, regarding an interconnected floor space and lobby exits.

The issue appears to be a follow up to Appeal #1077, but we should point out that you fail to comply with that decision. The interconnected floor space does not conform to Clause 3.2.8.1.(8)(d), thus it would not qualify for the exemption under Sentence 3.4.4.1.(7). It seems that you may be requesting a relaxation of the provisions of the Code, but if so, we have no authority to grant such relaxation. If you are attempting to provide an equivalent safety factor using a different method to the Code, then we suggest that you discuss this with the authority having jurisdiction before approaching the Appeal Board.
