Rationale:
The Nisga’a Lisims Government (NLG) has expressed safety concerns with the discrepancy between Nisga’a law and the current B.C. hunting regulation for Highway 113 (Nisga’a Highway). Under the Nisga’a Final Agreement (Nisga’a Treaty), the Nisga’a Lisims Government (the governing body of the Nisga’a Nation) enacted the Nisga’a Hunting Regulation, made under the Nisga’a Fisheries and Wildlife Act. (Part IV, s.26):
6. No person may hunt wildlife with a firearm or a bow in the following areas:
NLG implemented this specific regulation as a high safety standard for their citizens and mirrored other Highway No Hunting Areas in B.C. (for example, Highway 3). This safety standard ensures safe hunting standards and safety for other Nisga’a land users (for example, mushroom and berry pickers) along Highway 113.
Currently, the B.C. Hunting and Trapping Regulations permit discharge of a shotgun or bow within 400 metres of either side of the road allowance on Highway 113, as Highway 113 is placed under the “400 metre single projectile (firearm) prohibited area”. Therefore, the current B.C. Hunting regulation does not align with Nisga’a law. This proposal will ensure consistency and safety for licensed harvesters and Nisga’a harvesters.
