Project Description

The project in question is a mobile home that has been installed on a permanent concrete blocking system on private land, not in a mobile home park.

Reason for Appeal

Sentences 7.4.6.5.(1) and 7.6.1.10.(1) provide a number of requirements for sewer and water connections for mobile homes. These requirements are to deal with the need for repeated connection and disconnection of services for homes which are intended to be relocated.

Appellant's Position

The appellant contends that the mobile home in question has been permanently installed on private land and is no longer a mobile home. Sentences 7.4.6.5.(1) and 7.6.1.10.(1) should not be applicable.

Building Official's Position

The building official maintains that both Sentences refer to systems "intended to serve a mobile home." The building in question is a mobile home and although it is no longer intended to be "mobile" the code does not make this distinction.

Appeal Board Decision #1488

It is the determination of the Board that the requirements of Sentences 7.4.6.5.(1) and 7.6.1.10.(1) are intended for locations such as mobile home parks where repeated connection and disconnection of services is anticipated. Where in the opinion of the authority having jurisdiction a mobile home is installed in such a manner as to be considered a permanent building there is no need to apply Sentences 7.4.6.5.(1) and 7.6.1.10.(1).
