Project Description

The project in question is a new single family dwelling with two storeys and a basement. One smoke alarm has been installed in the basement and another has been installed on the ceiling of the second storey hallway near the top of the open stairwell This stairwell leads all the way to the basement.

Reason for Appeal

Sentence 9.10.18.2.(3) requires at least one smoke alarm on each storey of the dwelling unit.

Appellant's Position

The appellant contends that with an open stairwell the two smoke alarms that have been installed are sufficient.

Building Official's Position

The building official maintains that the code clearly requires at least on alarm on each storey. A smoke alarm must be added on the first storey.

Appeal Board Decision #1410

It is the determination of the Board that a smoke alarm is required to be located on each storey of the dwelling. The smoke alarm at the top of the open stairwell serves only the top storey and cannot also serve the storey below.
