Summary

This section explains when the director may provide information on contraventions, complaints and investigations relating to a person named in the request.

Searching of records

101.1 On the written request and payment of a prescribed fee by a person, the director may

(a) conduct a search of records maintained by the director for information, in respect of a person named in the request, related to contraventions of this Act or the regulations or complaints or investigations under this Act, and

(b) provide that information to the person who made the request and paid the fee.


Policy Interpretation

This section is used for due diligence searches when businesses are being sold. The director will provide information relating to complaints or investigations under the Act upon receipt of a written request which is accompanied by a fee of $35.

The disclosure must be authorized by the person named in the request in accordance with accountability requirements for government financial transactions.
