Bulletin 25-05: Update to Manufacturer Terms and Conditions for producing non-intoxicating beverages

What's changing

The LCRB has updated the Manufacturer Terms and Conditions to provide clearer direction on the production of non-intoxicating beverages. New terms and conditions clarify that manufacturers can use their licensed facilities to make non-intoxicating beverages such as soda, tonic, and non-alcoholic and de-alcoholized beverages. They may also solicit and receive orders for non-intoxicating beverages they make and sell or serve these product samples in a sampling area.

This clarification supports ongoing innovation in the sector and aligns the terms and conditions with current industry practice. The LCRB does not regulate these products, so producers are responsible for ensuring they comply with all applicable requirements from relevant agencies related to the production and sale of these products.

While manufacturer facilities can be used to produce non-intoxicating beverages, a licensee must continue to use their establishment for the manufacture of alcohol to maintain their licence.  

Helpful information

No action is required from licensees for this change to take effect. There is no requirement to notify the LCRB before starting production of non-intoxicating beverages.

No additional reporting requirements are introduced with this update, but manufacturers should maintain standard production and sales records for their business operations.
