This section lists which provisions of the Employment Standards Act do not apply to delivery services workers and ride-hail services workers.

Delivery services and ride-hail services workers
34.3 The following provisions of the Act do not apply to delivery services workers and ride-hail services workers:
(a) section 27;
(b) Part 4, other than section 39;
(c) Part 5;
(d) section 49.1 (1) (a);
(e) section 52.13;
(f) section 52.5 (4) (a);
(g) Part 7;
(h) section 65 (1) (a).
Policy Interpretation
The following provisions of the Employment Standards Act do not apply to delivery services workers and ride-hail services workers:
- Section 27 Wage Statements
- Instead, Regulation Section 45.31 Wage statement must be given by employer requires employers to provide wage statements with specific additional information to delivery services workers and ride-hail services workers
- Part 4 — Hours of Work and Overtime
- Exception: Section 39 No excessive hours does apply to delivery services workers and ride-hail services workers
- Part 5 — Statutory Holidays
- Subsection (1) (a) of Section 49.1 Illness or injury leave (paid sick leave)
- Section 52.13 Leave for COVID-19 vaccination
- Subsection (4) (a) of Section 52.5 Leave respecting domestic or sexual violence (paid leave)
- Part 7 — Annual Vacation
- Subsection (1) (a) of Section 65 Exceptions (temporary employees)
