Employment Standards doesn't have jurisdiction to resolve concerns involving employees who are under a collective agreement or part of a union.
Unions have collective agreements that set workplace standards for their members. Section 3(7) of the Employment Standards Act states that issues about the application of the Act in a unionized workplace, or the interpretation of a collective agreement, must go through the union's grievance procedures.
