Modern Treaty Nations can enter into a coordination agreement with the Province to have the Act and its regulations apply (partially or fully) to their lands.  

The intent is to enable Modern Treaty Nations to access features of the Act and regulations of their choosing to help them to enforce their own short-term rental laws and regulations.  

This provision extends to Modern Treaty Nations, including the Tsawwassen First Nation, Tla’amin Nation, Huu-ay-aht First Nations, Ka:’yu:’k’t’h’/Chek’tles7et’h’ First Nations, Toquaht Nation, Uchucklesaht Tribe, Yuułuʔiłʔatḥ Government, and Nisg̱a’a Nation.  

The Act and the coordination agreement provisions do not apply to other First Nations. 

A coordination agreement is a legal agreement that implements select services or regulations of federal or provincial governments on First Nations lands, respecting First Nations’ right to self-governance.  

The Act’s coordination agreement approach recognizes that Modern Treaty Nations have overarching law-making authority to regulate housing and land use on their Treaty lands and may wish to access provisions in the Act to support the enforcement of their own short-term rental regulations.
