Section 73.2 - Court Order for Return of Personal Information
Summary
Section 73.2 authorizes the head of a public body to seek a court order to compel the return of personal information if the individual or organization does not comply with a written demand for return. See section 73.1 for more information on recovery of personal information.
Policy
- This section is not intended to limit any other options the public body may have.
Procedure
- In the event that an individual or organization does not comply with a demand issued under section 73.1, and the public bodies chooses to seek a court order, the public body may ask the Attorney General to petition the superior court for an order requiring the return of the personal information.
