Section 73.2 - Court Order for Return of Personal Information

Summary

Section 73.2 authorizes the head of a public body to seek a court order to compel the return of personal information if the individual or organization does not comply with a written demand for return. See section 73.1 for more information on recovery of personal information.

Policy

  1. This section is not intended to limit any other options the public body may have.

Procedure

  1. In the event that an individual or organization does not comply with a demand issued under section 73.1, and the public bodies chooses to seek a court order, the public body may ask the Attorney General to petition the superior court for an order requiring the return of the personal information.
