Summary

This section lists the information that online platform companies need to provide to online platform workers about platform work offers.

Information to be provided in relation to platform work offer

45.30 (1) A platform work offer must specify at least the following information:

(a) the anticipated location at which the passenger or applicable online order is to be picked up;

(b) the anticipated location at which the passenger or applicable online order is to be dropped off;

(c) an estimate of the amount that will be payable if the platform work offer is accepted and the platform work assignment completed, which amount is to be the sum of the estimated online work earnings and distance expense allowance that will be payable.

(2) The location described in subsection (1) (a) or (b) must be no more than 300 m from the actual location.


Policy Interpretation

According to the definition in the Employment Standards Regulation, a platform work offer is an assignment offered to a worker through an online platform (an app) for delivery or ride-hail services.

Subsection 1(a) and (b)

A platform work offer must indicate where a rider or product is to be picked up and where they will be delivered (within 300 m of their actual pickup and delivery locations).

Subsection 1(c)

A platform work offer must include an estimate of the total amount a worker is anticipated to receive for accepting and completing the offer. This amount is the total of the money payable for delivering the passenger or order (the online work earnings), plus any amount payable due to the distance travelled in completing the assigned work (the distance expense allowance).​

Different online platform operators may provide this information in different ways. The law only requires the offer to indicate the pick up and drop off locations, and the estimated total amount. "Estimate" refers to a reasonable approximation only.

Online platform operators may indicate the estimated travel distance and online work earnings separately from the estimated distance expense allowance, but the law doesn't require them to do so. Online work offers may provide the total earnings and distance expense together (i.e. a bundled offer).

An online work offer may include information similar to the following example:

Estimated payment: $8.89

This is all the information that the online platform operator needs to provide. They may indicate that the estimated payment includes $6.55 in online work earnings and $2.34 in distance expense allowance (5.2 kilometres travelled at $0.45/km), but they don't have to.

Subsection (2)

The estimated pick up and drop off locations provided in the online platform work offer must be within 300 meters of the actual pick up and drop off locations.
