Summary

This section prescribes health professions and individuals for the purposes of the definitions of "health practitioner" and "health-related leave" in section 49.2 of the Act.


Text of Legislation

45.032 (1) All designated health professions, within the meaning of the Health Professions Act, other than the designated health professions of medicine and nursing, are prescribed for the purposes of paragraph (c) of the definition of "health practitioner" in section 49.2 (1) of the Act.

(2) An individual who is a member of an employee's immediate family is prescribed in relation to the employee for the purposes of the definition of "health-related leave" in section 49.2 (1) of the Act.


Policy Interpretation

Subsection (1)

For the purposes of determining whether an employer can request a sick note from an employee, doctors and nurses are designated as “health practitioners” by sections 49.2(1)(a) and (b) of the Act. This section of the Regulation provides that any health professional designated under the Health Professions Act is also a “health practitioner” for that purpose.

Subsection (2)

An employee’s absence due to the health, illness or injury of an immediate family member is designated as a “health-related leave” for the purposes of section 49.2 of the ESA.
