Digital Learning Strategy (DLS) Open License

Preamble and acceptance of License terms

You are entitled to use the DLS, as made available by the Province under this License, and by doing so You are unconditionally accepting the following terms and conditions.

If You do not agree with these terms and conditions, You must not use any component of the DLS.

Rights

Subject to the conditions set out below, the Province hereby grants to You a worldwide, royalty-free, perpetual, non-exclusive right to use the DLS and You may:

  • create a Modified DLS in any manner for any lawful purpose;
  • copy, publish, distribute, or otherwise use the DLS or any Modified DLS in any medium, mode or format for any lawful purpose; and
  • sublicense others to use Your Modified DLS.

Conditions

In order to be allowed to exercise the above rights, You must abide by these conditions:

  • You must change the name of any Modified DLS to distinguish it from the Province’s DLS, even if any modifications You make to the DLS are inconsequential;
  • You must acknowledge the source of the DLS by including the following attribution statement with the DLS and any Modified DLS that You use under this License:

  • You must not, unless otherwise instructed by the Province, remove or in any way alter any disclaimer or other notice that is provided by the Province in, on or associated with the DLS;
  • You must not use the DLS or any Modified DLS in any way that claims or suggests any official status or that the Province endorses either You or Your use of the DLS or Modified DLS; and
  • it is Your responsibility to exercise due diligence in ensuring that any version of the DLS or Modified DLS that You use, copy, publish, distribute, translate, adapt or modify in accordance with this License is, and remains, accurate and current.

These License conditions are important and, if You fail to comply with any of them, the rights granted to You under this License, or any similar license granted by the Province, will end automatically.

License to the Province

You are encouraged to share Your Modified DLS, including any related policies and processes, and/or submit Your suggested edits or updates to the DLS to the Province by email to: AEST.DPP@gov.bc.ca.

If you do make any of these materials available to the Province, You hereby grant a worldwide, royalty-free, perpetual, non-exclusive right for the Province to use, copy, publish, distribute, translate, adapt and modify these materials, including by incorporating any or all of them into the DLS.

Exemptions

This License does not:

  • grant You any rights except those specifically stated above;
  • cover any personal information or other information that is not accessible under the Freedom of Information and Protection of Privacy Act (BC);
  • include any information, or grant You any third party rights in the DLS, that the Province does not own or is not authorized to license to You; or
  • grant You any other intellectual property rights, including any rights to use any trademark(s), official mark(s) or Provincial symbol(s), that are either owned or used under license by the Province.

No warranty

The DLS is licensed 'as is' and the Province disclaims and excludes all representations, warranties, obligations and liabilities, whether express or implied, in relation to the DLS to the maximum extent permitted by law.

The Province is not liable for any errors or omissions in the DLS, or those that may arise in a Modified DLS, and will not under any circumstances be liable to You or any third party for any direct, indirect, special, incidental, consequential or other loss, injury or damage of any kind caused by Your, or any third party’s, use of or reliance on the DLS or any Modified DLS or otherwise arising in connection with this License or the DLS, even if specifically advised of the possibility of such loss, injury or damage.

The Province does not guarantee the continued supply or availability of the DLS.

Governing Law

This License is governed by the laws of the province of British Columbia and the applicable laws of Canada.

Any legal proceedings related to this License or the DLS may only be brought in the courts of British Columbia.

Definitions

In this License, the terms defined below have the following meanings:

"DLS" means the Province’s electronic “Digital Learning Strategy” resource, with the following components:

  • Introduction, Strategic Priorities and Action Plan,
  • Appendices:
    • Appendix 1 - Guidelines for Technology-Enhanced Learning;
    • Appendix 2 – The B.C. Post-Secondary Digital Literacy Framework; and
    • Appendix 3 - Capabilities Mapping.

and any other information or other content that is specifically listed under the heading "DIGITAL LEARNING STRATEGY" on the Province's webpage located at: Digital Learning Strategy

"License” means this Digital Learning Strategy (DLS) Open License.

"Modified DLS” means any version of the DLS that has been modified, translated, and/or adapted under this License. "Province" means His Majesty the King in right of the Province of British Columbia.

"You" or "Your" means the natural or legal person, or body of persons corporate or incorporate, acquiring or exercising rights under this License on their own behalf or on behalf of any third party.

About this License

This is version 1.0 of the Digital Learning Strategy (DLS) Open License.

The Province may make changes to the terms of this License from time to time and issue a new version of this License.  If You are already using the DLS or Modified DLS under a previous version of this or any other license, those prior license terms will continue to apply to Your use of that DLS or Modified DLS unless and until they are expressly superseded or otherwise revoked by the Province.
