How to Report a conflict of interest as a BC Public Service employee

Before you start

If you think that you may be in a possible conflict of interest situation, you should:

  • Review the Standards of Conduct to understand how a conflict of interest is defined
  • Make a list of your job duties or responsibilities
  • Make a list of any personal interests that you think might be in conflict with your duties

Overview

All employees who think they may be in a conflict of interest are required to disclose the situation to their supervisor, manager or ethics advisor.

Disclosure must take place in a timely manner – within 30 days - from the time that the employee becomes aware of a possible conflict.

Report to your supervisor/manager or ethics advisor

If you think that you could be in a conflict, speak to your supervisor/manager within 30 days (if possible.) Tell them the reasons why you think you may be in a conflict, including the duties interests and steps you identified in Step 1 of this process.

If you prefer, you can contact your Ministry ethics advisor instead of your manager.

Initial assessment

Your supervisor, manager (or the ethics advisor) will make a preliminary judgement as to whether a possible conflict of interest issue exists based on the facts available. In some cases, they may decide that the issue is straightforward and can be addressed informally. In this case, your supervisor/manager will work with you to take steps to resolve or mitigate the conflict. In these cases your responsibility as an employee is to implement the action or plan. There is no need to do anything further.

Disclosure

Your manager (or the ethics advisor) may ask you to fill out the Conflict of Interest Employee Disclosure form. This form helps you organize your thinking and provide an overview of the situation, your job duties, and identify areas of overlap or possible conflict.

Assessment of disclosure and next steps

Once you have submitted the Conflict of Interest disclosure form, your supervisor/manager (or the ethics advisor) will reply with a decision, directions and next steps for resolving any possible conflict. In these cases, your responsibility as an employee is to implement the action or plan. The decision will be documented, and copies will be shared with you and your supervisor/manager. A copy will be sent to your personnel file at the BC Public Service Agency (in case your supervisor/mangers' role changes.)
