Reconsideration

The reconsideration process provides an opportunity to dispute some decisions made by the Early Childhood Educator (ECE) Registry. You can request reconsideration if the ECE Registry made a decision to take action on your application for certification or on your certificate.

Right to reconsideration

You have the right to request reconsideration if the ECE Registry made one or more of the following decisions:

  • Denied your application for a certificate
  • Intends to issue or renew your certificate with terms and conditions
  • Intends to attach terms and conditions or vary terms and conditions on your certificate
  • Intends to suspend or cancel your certificate
  • Took immediate action on your certificate (suspends, attaches terms and conditions, or varies terms and condition on your certificate)

If you decide to request reconsideration, you must make your written request to the ECE Registry within 30 days of being notified of the ECE Registry’s decision.


How to request reconsideration

To request reconsideration, you must:

When you complete the form, you will need to explain why you are requesting reconsideration. Reasons may include:

  • The decision was not in accordance with legislation (Community Care And Assisted Living Act and/or Child Care Licensing Regulation
  • The decision was incorrect
    • For example, you met the legislative requirements when the decision was made
  • The decision-making process was unfair (the principles of administrative law and procedural fairness were not followed)
  • There is new information or evidence that was not available to the ECE Registry when the original decision was made

Reconsideration process

The ECE Registry will review your Request for Reconsideration form, supporting documents, the original decision, and all other relevant information. The ECE Registry may verify information or request clarification.

You will receive a letter explaining the reconsideration decision. The possible outcomes of a reconsideration are:

  • The original decision is upheld
    • For example, a certificate is not issued
  • A less restrictive action is taken
    • For example, terms and conditions are attached instead of suspending a certificate
  • The original notice (decision) is rescinded, and no action is taken
    • For example, a certificate is issued without restriction

Right to appeal a reconsideration decision

The appeal process may provide an opportunity to dispute the reconsideration decision made by the ECE Registry. Contact the Community Care and Assisted Living Appeal Board within 30 days of receiving the reconsideration decision for more information about the appeal process.
