Project Description

The project is a multiple suite residential building that incorporates self contained mechanical ventilation systems in each dwelling unit. The ventilation systems are designed in accordance with Subsection 9.32.3.

Reason for Appeal

Sentence 9.32.3.4.(1) requires a principal exhaust fan to be controlled by an adjustable time control device set to provide a minimum of two 4-hour operating periods per day.

Appellant’s Position

The appellant contends an adjustable timer switch that is capable of being set to provide two 4-hour operating periods per day and also includes an on /off switch, would satisfy the requirements of Sentence 9.32.3.4.(1).

Building Official’s Position

The Building Official considers the adjustable timer that also includes an on / off switch would not comply with Sentence 9.32.3.4.(1), since it would allow the occupant to turn off the principal fan.

Appeal Board Decision #1555

It is the determination of the Board that an on/off switch in addition to the adjustable timer complies with the requirements of the Code.
