Overdue Environmental Court Penalties

Effective mechanisms must be in place for collecting environmental court penalties if they are to have the intended effect of deterring harmful behaviours - especially those most harmful behaviours that are prosecuted through the courts.

Court penalties include court fines and in many cases creative sentencing orders provided at the discretion of the judge. Typically these orders are monies that are payable to organizations such as the Habitat Conservation Trust Foundation; court fines are payable to the Province.
