Summary

This section specifically excludes certain tuition costs under the Police Act charged to a municipal constable from being recoverable as an unauthorized deduction under the Act. 


Text of Legislation

37.11. Section 21(2) of the Act does not apply to tuition charged to a municipal constable as defined in section 1 of the Police Act for enrolment in the Police recruit training program as defined in Subject 2.1.1 of the Provincial Policing Standards as established under section 40 (1) (a.1) of the Police Act and as amended from time to time.


Policy Interpretation

Under s.21(2) of the Act, an employer is prohibited from requiring an employee to pay for any business costs, except as permitted under the Regulation.

Accordingly, tuition costs charged to a municipal constable, as identified in this section, are specifically excluded from what is considered a “business cost” for purposes of the Act. Any such costs are not recoverable under s.21(2) of the Act.
