ESR Section 37.11 – Municipal police recruits
This section specifically excludes certain tuition costs under the Police Act charged to a municipal constable from being recoverable as an unauthorized deduction under the Act.
37.11. Section 21(2) of the Act does not apply to tuition charged to a municipal constable as defined in section 1 of the Police Act for enrollment in Block I, II or III of the “peace officer basic training program” as defined in section 1 of B.C. Reg. 109/81.
Under s.21(2) of the Act, an employer is prohibited from requiring an employee to pay for any business costs, except as permitted under the Regulation.
Accordingly, tuition costs charged to a municipal constable, as identified in this section, are specifically excluded from what is considered a “business cost” for purposes of the Act. Any such costs are not recoverable under s.21(2) of the Act.
