Summary
This section details the time-limit on commencement of court proceedings when those proceedings are based on offences under the Employment Standards Act.
Text of Legislation
124. No proceeding for an offence under this Act may be commenced in any court more than 2 years after the facts on which the proceeding is based first come to the director's knowledge.
Policy Interpretation
The time limit for initiating proceedings for offences under this Act is 2 years.
The time limit begins on the date the facts on which the proceeding is based come to the attention of the person conducting the investigation.
