Appealing Assessments of Oil & Natural Gas Royalties, Taxes, Penalties or Producer Prices

If you disagree with an assessment of royalties, taxes, penalties or producer prices, there are steps you may take, depending on the type of disagreement:

Appeals Process

Invoice or Assessment Disagreement: A producer disagrees with an invoice or assessment of royalties, taxes or penalties:

  1. Contact the Ministry of Finance to discuss your concerns
  2. If your concerns are not resolved, you may then request reconsideration by the Collector
  3. If your concerns are still not resolved, you may then appeal to the Minister of Finance

Producer Price Disagreement: A producer disagrees with a producer price:

  1. Contact the Ministry of Energy, Mines & Petroleum Resources to discuss your concerns
  2. If your concerns are not resolved, you may then request reconsideration by the Administrator
  3. If your concerns are still not resolved, you may then appeal to the Minister of Finance

Producer Price Disagreement: Call the Ministry of Energy, Mines & Petroleum Resources staff member you’ve been working with, or call 250 952-0215, or email PDATA.PDATA@gov.bc.ca.

Request a Reconsideration

You can formally request a reconsideration if you still have concerns after you have contacted us by phone.

The Collector will review the assessment and determine whether to change or uphold the original assessment.

Producer Price Disagreement: Submit details of your objection:

The Administrator will review the producer price and determine whether to change or uphold the original producer price.

Appeal to the Minister

You can formally appeal to the Minister of Finance if you still have concerns after you have followed the steps above for your disagreement type.

You must submit your notice of appeal by registered mail within 60 days of the date on your reconsideration decision letter from the Collector or Administrator.

The Minister’s decision is final and may not be appealed to the courts.
