Project Description

This appeal concerns the installation of a floor mounted water closet in a dwelling.

Reason for Appeal

Sentences 7.3.3.8.(1) and (4) require the trap flange of the water closet to be bolted to the floor flange of the fixture drain. Sentence 7.3.4.1.(2) requires a floor or wall mounted water closet to be securely attached to the floor or wall by means of a flange and to be stable.

Appellant's Position

The appellant contends that the water closet in question is certified to Canadian standards and has been installed in conformance with the manufacturer’s instructions. The product specifications indicate conformance with CAN/CSA-B45.1 as required by Sentence 7.2.2.2.(2) and conformance with the “NPC Canada.” This water closet is routinely installed throughout the region and approved by other jurisdictions and engineers.

Building Official's Position

The building official maintains that the toilet must be bolted to the flange that is attached to the drainage system. The toilet in question attaches to an adapter that is attached to the flange and therefore does not meet the requirements of the above Sentences.

Appeal Board Decision #1701

It is the determination of the Board the water closet in question and its method of installation is in conformance with the requirements of Sentences 7.3.3.8.(1) & (4) and 7.3.4.1.(2). The flange of the outlet connector supplied as part of the water closet is bolted to the floor flange in conformance with Sentence 7.3.3.8.(4) and is also bolted to the floor. The water closet, in turn, is bolted to the outlet connector in conformance with Sentence 7.3.4.1.(2).
